RPC statement: impact of biodiversity gain regulations from DEFRA
Update on our scrutiny of the impact assessment from the Department for Environment, Food and Rural Affairs.
The Regulatory Policy Committee received an impact assessment for The Biodiversity Gain (Town and Country Planning) (Amendments and Transitional Provisions) (England) Regulations 2026 from the Department for Environment, Food and Rural Affairs on 11 June 2026.
The regulations and impact assessment were laid before Parliament on 13 July 2026.
We are independently scrutinising the quality of the evidence and analysis used by the department to support the case for regulation.
Our opinion of the impact assessment will be published for transparency as soon as our scrutiny process has been completed.
